These Terms of Service ("Terms") govern your use of the MZ Vocal Coaching ("MZVC," "we," "us," "our") website and your purchase of our services. By booking a consultation, purchasing a service, or using our website, you agree to these Terms. If you don't agree, please don't use our website or services.

1. Our Services

MZVC provides online vocal coaching delivered by video call, including:

• Consultations: a free consultation to discuss your goals and determine whether our services are a fit

• Private lessons: 50-minute one-on-one online lessons, tailored to your ability, goals, and repertoire

• 12-Week Program: a structured program of twelve weekly 50-minute sessions, with personalized weekly homework, a structured practice plan, and accountability

Service details, descriptions, and prices are shown on our website, in our booking system, or in your consultation.

2. Eligibility and Bookings for Minors

You must be at least 18 to book our services. If the student is under 18, a parent or legal guardian must make the booking, agree to these Terms on the student's behalf, and be available as needed during lessons. Parents and guardians are responsible for the student's compliance with these Terms.

3. Booking and Payment

• Prices are in Canadian dollars

• Full payment is required at the time of booking.

• Payments are processed securely by Square and Stripe.

• You are responsible for providing accurate contact and payment information.

4. Scheduling, Cancellation, and Rescheduling

• 24-hour notice: To cancel or reschedule a lesson or session, you must give us at least 24 hours' notice.

• Late cancellations and no-shows: Lessons cancelled with less than 24 hours' notice, and missed sessions, are non-refundable and are treated as delivered.

• Lateness: If you arrive late, the session still ends at its scheduled time.

• Our cancellations: If we need to cancel or reschedule a session, we will give you as much notice as possible and offer a replacement session at no charge.

5. Refunds

Lessons, packages, and programs are non-refundable once purchased, except where a refund is required by applicable law. Nothing in these Terms limits any rights you have under Ontario consumer protection legislation.

6. 12-Week Program Guarantee

If you complete the 12-Week Program and have met all of the program requirements below but have not achieved the goals we defined together at the start of the program, we will continue coaching you at no additional charge for up to 3 additional sessions completed within 1 month after the initial 12-Week Program ends until.

Program requirements:

• Attend all twelve scheduled sessions, subject to the cancellation policy in Section 4.

• Complete the weekly homework assignments.

• Follow the structured practice plan.

Conditions:

• Your goals will be defined together in writing at the start of the program, and must be specific and realistic for the program's timeframe and your current ability.

• The guarantee is a promise of additional coaching. It is not a cash refund, and it is not a guarantee of any particular outcome, career result, or performance.

• Additional coaching under the guarantee will only occur if you have not achieved the agreed upon goal.

• Additional coaching under the guarantee is provided within 1 month of program completion.

• Additional coaching under the guarantee includes no more than 3 additional sessions.

• The guarantee applies only to the 12-Week Program.

7. No Guarantee of Results

Vocal progress depends on many factors, including your starting point, physical characteristics, health, consistency of practice, and effort. Except for the coaching guarantee in Section 6, we do not guarantee any specific result, timeline, range, skill level, or outcome. Any testimonials or examples we share reflect individual experiences and are not a promise that you will get the same results.

8. Health and Vocal Safety

Our coaching is educational and is not medical advice. Singing should not cause pain. If you experience pain, persistent hoarseness, or voice loss, stop singing and consult a physician or a qualified voice specialist. You are responsible for singing within your physical limits and for telling us about any vocal health conditions relevant to your training. You participate in lessons and practice at your own risk.

9. Technology Requirements

You are responsible for a reliable internet connection, a compatible device, a working microphone and camera, and a suitable, quiet space for lessons. If a technical issue on your end prevents or shortens a session, it is treated as a delivered session. If a technical issue on our end prevents a session, we will reschedule it at no charge.

10. Recordings

We may record lessons for your own review and practice. Recordings are for you and for MZVC's internal use, and we will not publish or share a recording of you, or use it in marketing, without your written permission.

You may not record, copy, or distribute lessons or any part of them without our written permission.

11. Intellectual Property

All content we provide, including lesson materials, exercises, practice plans, worksheets, videos, course content, and website content, is owned by MZVC and protected by copyright. You receive a personal, non-transferable license to use these materials for your own learning. You may not copy, sell, share, redistribute, or publish them without our written permission.

You keep ownership of your own songs, lyrics, and original material. Where we use a testimonial, recording, or before-and-after example of your progress in our marketing, we will do so only with your permission.

12. Referral Credits

If you refer a new student who books through our booking system, you may receive $25 off your next lesson package. Credits have no cash value, cannot be combined with other credits or offers unless we say so, and apply only to purchases by the referring student. We may change or end the referral program at any time.

13. Conduct

We expect respectful behaviour in lessons and communications. We may end our services to anyone who is abusive, harassing, or disruptive, or who violates these Terms. In that case, unused sessions are not refundable, except where required by law.

14. Limitation of Liability

To the fullest extent permitted by law, MZVC and its owner are not liable for any indirect, incidental, or consequential damages, or for lost income, lost opportunities, or damage to your voice, arising from your use of our services or website. Our total liability for any claim relating to our services is limited to the amount you paid us for the services giving rise to the claim. Nothing in these Terms excludes liability that cannot legally be excluded.

15. Privacy

Our Privacy Policy explains how we collect, use, and share your information. By using our services, you also agree to it.

16. Changes to These Terms

We may update these Terms from time to time. The version in effect when you purchase applies to that purchase. The "Last updated" date shows the latest revision.

17. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there. Any dispute will be resolved in the courts of Ontario, subject to any consumer rights you have to bring a claim elsewhere.
